Delay In Diagnosing Fetal Distress May Be Medical Malpractice

A recent medical malpractice lawsuit filed in Federal Court alleges that a doctor and the medical center were negligent during the birth of a mother and father's infant child. The lawsuit was filed pursuant to the tort claims act and asserts that serious errors and delay in assessment and treatment of the pre-term infanct lead to the rapid deterioration and subsequent death of the child.

According to the birth injury claim, the mother arrived at the labor and delivery department in late January, 2013 and presented with severe vaginal bleeding, rupture of the amniotic sac and poor variability on fetal heart monitor tracings. These symptoms were consistent with placental abruption, a dangerous condition. The lawsuit alleges that the physician in change failed to identify the emergent nature of the situation, and failed to take to proper steps including calling for an immediate Cesarean section. The child was born having suffered prolonged hypoxia and died shortly thereafter.

The negligence lawsuit claims that the doctor failed to act pursuant to the requisite standard of care by failing to properly diagnose and address the severity of the danage the mother faced. Further, as the result of the delay in diagnosisis, the baby was deprived of the potential opportunity to recover. The family is seeking damages in excess of $1 million.
