Trial Begins In Birth Injury Lawsuit

Legal news reports that jury selection has just begun in a medical malpractice lawsuit. The birth injury case focuses on the actions/inaction of an obstetrician during the labor and delivery process.

According to the lawsuit, the preventable negligence of the doctor and the hospital staff led to the boy's oxygen deprivation, which in turn caused the boy to suffer brain damage.

If you believe that the negligence conduct of a doctor, nurse or other healthcare professional may have harmed you or your loved one, it's a good idea to consult with a skilled birth injury attorney who can help you gather facts and evidence concerning your matter. Where medical professionals fail to act with the requisite standard of care and harm occurs, you may be able to recover compensation to help cover the often insurmountable costs of medical care.

In this instance, the mother went to the hospital to deliver her baby – who was 15 days overdue. Because she still was not in labor, she was given Pitocin to induce labor. For more than 11 hours staff continued to increase the dosage. The mother was then instructed to begin pushing, although the head was not positioned correctly. Subsequently, the baby's heart rate dropped and it was determined that an emergency C-section was necessary. When the baby was delivered, he was unable to breathe.

He is now diagnosed with cerebral palsy, a neurological disorder that affects movement and coordination. The medical malpractice lawsuit seeks both economic and noneconomic damages to help improve the boy's quality of life.
