Improper Resolution of Shoulder Dystocia Leads to Birth Injury

A recently filed birth injury lawsuit has alleged that the negligence of a health care facility was responsible for harming her child. According to the complaint, at 37 weeks the mother went to the health care facility after going into labor. She experienced a particularly long labor and was diagnosed with respiratory distress, likely a result of prolonged shoulder dystocia. Shoulder dystocia is a complication of labor where the newborn's shoulders are stuck in the birth canal. Although the situation is complicated, it can be managed with proper and competent medical care. However, if managed incorrectly and excessive force is used, a brachial plexus injury can result.

In this instance, the plaintiff alleged that as the result of the actions of the obstetrician – who failed to follow the appropriate standard of care - the child suffered a severe and permanent brachial plexus injury. A brachial plexus injury refers to an injury to the network of nerves in the shoulder that control the movement and sensation of the arm, and sometimes hand.

The brachial plexus lawsuit is seeking damages including past and future medical expenses, past and future economic damages and pain and suffering.
