Birth Injuries May Be The Result of Medical Malpractice

Having a child can be an emotional time for parents. On one hand it can be a magical and joyous time for parents. It can also be a time of stress and anxiety. Further, what happens if there a complications and something goes wrong during the delivery leading to an injury of the mother or child?

Many conditions and circumstances can arise that may in personal injury/negligence claims – for both for the mother and the baby.

For example, where an expectant mother suffers from one of several different medical conditions, the failure to diagnose, treat and prepare for potential complications that may arise during the pregnancy and/or delivery can be the basis for a medical malpractice lawsuit. Gestational diabetes and pre-eclampsia, are issues that should be diagnosed by a woman's doctor during her pregnancy. If a doctor doesn't monitor these issues, or properly diagnose them, and the mother suffers harm, the woman may be able to show that the physician and/or hospital was negligent.

Additionally, several birth injuries – such as cerebral palsy – have been linked to negligence at birth. This may occur when a doctor fails to act quickly enough to deliver a baby in distress and the child experiences a lack of oxygen. Other times, the child's size is not properly monitored, leading to difficult deliveries and the possibility of shoulder dystocia or a brachial plexus injuries. Pre-mature births that could have been prevented, and where the child suffers harm as a result, may also be form the basis of a birth injury claim.

If you believe that you or your child suffered an injury as the result of negligence during pregnancy or labor and delivery, please contact the experienced California birth injury lawyers at Bostwick & Peterson, LLP for an immediate, confidential consultation.
