Defensive Medicine Not Significant Factor In High Health Care Costs

While the majority of hospital visits go smoothly, however, even well-intended and experienced medical professionals can make mistakes, become careless or fail to take the correct action under strain or pressure.

When negligent actions or a failure to act cause an injury at birth, this is a form of medical malpractice and the responsible party should be held accountable. By filing a medical malpractice lawsuit, injured parties and their family members can seek compensation for the harm caused as the result of negligence. These lawsuits are critical to bring justice to those harmed.

Opponents of medical malpractice lawsuits have long claimed that one reason medical costs are high is that doctors practice "defensive medicine" – ordering expensive and unnecessary tests to protect themselves from liability. However, the result of a recent medical malpractice study released by Rand Corporation show that stricter limits on medical negligence lawsuits does not have much of an impact in the volume or cost of emergency room care.

In fact, the study published in the New England Journal of Medicine suggests that physicians are "less motivated by legal risk than they themselves believe."

This finding challenges the argument that "defensive medicine" is a driver of the high cost of medicine.

Ensuring you and your family obtain the justice you deserve if your child has sustained a birth injury as the result of negligent medical care is crucial. Please contact the top California birth injury lawyers at Bostwick & Peterson immediately if you believe your child has been the victim of medical malpractice.
