Medical Malpractice Lawsuit Filed Following Labor and Delivery Complications

The family of a baby born with a severe brain injury has now filed a medical malpractice lawsuit against the hospital and doctors who delivered and treated the child. The lawsuit alleges that the medical staff was negligent in several ways, and that as a result of the breach of numerous standards of care, the boy suffered harm.

According to the birth injury complaint, the mother came to the hospital when she was 36 weeks pregnant, suffering pelvic pressure and secretions. An exam revealed that her cervix was preparing to give birth. She was admitted to the hospital to be induced. The mother and child suffered complications during the delivery – including the baby's shoulder becoming stuck in the mother's birth canal – a sign of shoulder dystocia. Doctors had to use vacuum extraction to assist with the deliver.

When the child was born, he was blue, flaccid and failed to respond to any stimuli. After being transferred to the ICU he was diagnosed with respiratory failure and perinatal asphyxia. He now experiences significant physical, motor and developmental delays.

The lawsuit alleges that the doctors and hospital are liable for failing to properly monitor and respond to the complications that arose during the child's birth and are seeking damages to help defray the substantial costs of medical care and assistance that may be required for the boy's lifetime.
