Jury awards family $23.5M in Birth Injury Lawsuit

Recently, a jury awarded in excess of $23.5M in a birth injury lawsuit.  The family filed the medical malpractice case after their daughter sustained a serious brain injury following delivery.

When birth injuries occur, the effects can be catastrophic and last a lifetime.

In this instance, the mother, 36-weeks pregnant, presented to a hospital with abdominal pain.  Following 24-hours of observation, she was discharged, placed on bedrest, and allowed to go back to work.  11 days later she returned to the hospital after being kicked in the abdomen.  Fetal monitor strips on that day showed that the baby was in distress, requiring immediate delivery via Cesarean Section.   However, doctors and hospital staff delayed the delivery by more than 3 hours.  When the child was born, she had sustained a severe brain injury due to a lack of oxygen. 

The award will help the family pay for a lifetime of care.
