Legal news reports that the family of a boy who suffered a severe birth injury has reached a $7.1 million settlement with the medical center where the injury occurred. According to the lawsuit, the boy suffered a significant delay during delivery, which led to a brain injury. The child was diagnosed with hypoxic ischemic encephalopathy (HIE).
HIE is a serious medical condition caused by decreased oxygen and blood flow that causes damage to the brain of a newborn. HIE typically occurs during the childbirth process or just after it, and is a very severe type of brain injury, often resulting in the wrongful death or permanent disability of a baby. In the recently settled medical malpractice action, the boy sustained the injury due to an alleged deviation from the established standards for obstetrical care during labor and delivery. As a result of that breach of care (i.e. negligent conduct) the boy suffered brain damage caused by a lack of oxygen, and is unable to walk or care for himself, requiring constant medical attention.
The settlement will help provide the necessary funds for the boy to obtain medical care and treatment throughout his life.
