Settlement Obtained in Medical Malpractice Birth Injury Case

Recently, the family of a boy who suffered a brain injury during birth obtained a $1.25 million birth injury settlement.  The boy was born with hypoxic ischemic encephalopathy (HIE).  HIE is a serious, lifelong medical condition that results from decreased oxygen and blood flow to the brain of a newborn.  Often, the effects of such birth trauma include serious disability and potential wrongful death.  This type of brain injury is often the result of difficulties during delivery, including uterine rupture, umbilical cord issues and other forms of birth trauma.  In some situations, brain cooling may be used to help lessen the extent of the injury, and provide the brain some healing. 

In this instance, the boy passed away 14 months after the birth trauma occurred.  The family asserted that complications in the delivery, including failing to monitor the mother’s reaction to Pitocin after it’s administration, and failing to perform an emergency Cesarean Section after the mother exhibited signs of fetal distress, led to the birth injury. 

The child later succumbed to his injuries.  The hospital reached a settlement with the family.
